1. Aceptación de los Términos

Al acceder y utilizar FashionApp (el "Servicio"), usted acepta estar sujeto a estos Términos y Condiciones. Si no está de acuerdo con alguna parte de estos términos, no debe utilizar el Servicio.

2. Requisitos de Edad (COPPA y Normativas Aplicables)

El Servicio está dirigido y reservado para usuarios que tengan al menos 13 años de edad. Al crear una cuenta o utilizar la plataforma, usted declara y garantiza que tiene 13 años o más. Se prohíbe estrictamente el uso del Servicio a menores de 13 años. Si descubrimos que hemos recopilado información de un menor de 13 años, eliminaremos dicha información y la cuenta asociada de inmediato.

3. Uso Aceptable y Conducta del Usuario

Usted es el único responsable de todas las imágenes, textos y contenidos que cargue en el Servicio. Al utilizar la aplicación, usted acepta NO:

Subir imágenes o material que sea ilegal, obsceno, difamatorio, pornográfico, amenazante o que incite al odio o a la violencia.
Subir contenido que infrinja los derechos de autor, marcas registradas, patentes o propiedad intelectual de terceros.
Intentar vulnerar, descompilar, sobrecargar o atacar la seguridad, la infraestructura o los algoritmos de visión e inteligencia artificial de la plataforma.
Utilizar el Servicio para cualquier propósito comercial no autorizado o reventa del procesamiento sin consentimiento previo por escrito.

Nos reservamos el derecho de eliminar cualquier contenido y suspender o cancelar cuentas que violen estas reglas, sin previo aviso.

4. Propiedad Intelectual

Sus prendas y contenido: Usted conserva todos los derechos de propiedad sobre las imágenes de las prendas y outfits que suba al Servicio. Al subirlas, nos otorga una licencia limitada, revocable y no exclusiva para procesar, almacenar y mostrar estas imágenes únicamente con el fin de brindarle las funcionalidades del Servicio.

Nuestro software y tecnología: El código fuente, diseño, logotipos, arquitectura, algoritmos propietarios de clasificación de color, componentes visuales y la tecnología de FashionApp son propiedad exclusiva de FashionApp y están protegidos por las leyes de propiedad intelectual de Colombia, Estados Unidos y tratados internacionales.

5. Disponibilidad del Servicio (MVP)

Actualmente, FashionApp se ofrece en su fase de Producto Mínimo Viable (MVP). El Servicio se proporciona "tal cual" (As-Is) y "según disponibilidad". No garantizamos que el Servicio será ininterrumpido, libre de errores o que todos los fondos de imágenes se recortarán con precisión del 100%. Nos reservamos el derecho de modificar, suspender o descontinuar el Servicio en cualquier momento.

6. Limitación de Responsabilidad

En la máxima medida permitida por la ley aplicable, FashionApp no será responsable de ningún daño indirecto, incidental, especial, ejemplar o consecuente que resulte del uso o la imposibilidad de usar el Servicio, ni por la pérdida o corrupción de datos (incluidas sus imágenes o armarios guardados).

7. Ley Aplicable y Jurisdicción

Estos Términos se regirán e interpretarán de acuerdo con las leyes de la República de Colombia y las leyes aplicables de los Estados Unidos de América, según corresponda a la jurisdicción del usuario, sin dar efecto a principios sobre conflictos de leyes.

1. Acceptance of Terms

By accessing and using FashionApp (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, you must not access or use the Service.

2. Age Requirements (COPPA Compliance)

The Service is intended and reserved solely for users who are at least 13 years of age. By creating an account or using the platform, you represent and warrant that you are 13 years of age or older. Use of the Service by children under 13 is strictly prohibited. If we discover that we have inadvertently collected personal information from a child under 13, we will promptly delete that information and terminate the account.

3. Acceptable Use and User Conduct

You are solely responsible for all images, text, and content that you upload or create on the Service. When using the application, you agree NOT to:

Upload images or material that is unlawful, obscene, defamatory, pornographic, harassing, threatening, or inciting violence or hatred.
Upload content that infringes upon the copyrights, trademarks, patents, or intellectual property rights of any third party.
Attempt to compromise, reverse-engineer, overload, or attack the security, infrastructure, or vision/AI processing algorithms of the platform.
Use the Service for unauthorized commercial purposes, bulk scraping, or resale without prior written consent.

We reserve the right to remove any content and suspend or terminate accounts that violate these rules without prior notice.

4. Intellectual Property

Your garments and content: You retain full ownership rights over the garment images and outfits you upload to the Service. By uploading them, you grant us a limited, revocable, non-exclusive license to process, crop, store, and display these images solely to provide and operate the Service for you.

Our software and technology: The source code, visual design, logos, architecture, proprietary color-detection heuristics, UI components, and software powering FashionApp are the exclusive property of FashionApp and are protected under international copyright and intellectual property laws.

5. Service Availability (MVP Disclaimer)

FashionApp is currently provided as a Minimum Viable Product (MVP). The Service is offered on an "AS-IS" and "AS-AVAILABLE" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that AI background removal will achieve 100% precision on every image. We reserve the right to modify, suspend, or discontinue any feature at any time.

6. Limitation of Liability

To the maximum extent permitted by applicable law, FashionApp shall not be liable for any indirect, incidental, special, punitive, or consequential damages resulting from your use of or inability to use the Service, or for any loss of data (including saved garments and wardrobe data).

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia and the applicable laws of the United States of America, as applicable to the user's jurisdiction, without regard to conflict of law principles.
